The penalties for first offense DWIs occurring after December 1, 2019 will be significantly lower, however, the offender will be required to install an Ignition Interlock Device ("IID").
For a first time DWI offender with a Blood Alcohol Content ("BAC") of between 0.08% and 0.10%, the license loss will be for 30 days, instead of 90 days, but the offender will be required to install an IID at his or her expense during the 30 day license suspension and for three to six months upon restoration.
If the BAC is 0.10% or higher but less than 0.15% BAC, or the person is convicted of driving under the influence of drugs, the driver’s license suspension is reduced from 7 months to 45 days and they must install the IID during the suspension and for 6 months to 1 year upon resoration.
If the BAC is 0.15% or higher, there is a 90 day license suspension. Also, the IID must be installed during the 90 day suspension and for 1 year to 18 months upon restoration
If the offender is convicted for the first time of Refusing to Provide a Breath Sample (39:4-50.4a) the license suspension 90 days, instead of 7 to 12 months. The offender is required to install the IID during the 90 day suspension and for 6 months to 1 year upon restoration.
Second or subsequent DWI offenders are subject to the same laws that exists now, however, but it now requires offenders of a second or subsequent DWI or Refusal to install an IID during the license suspension and after the expiration of the period of license suspension and for 1 to 3 years upon restoration.
