Family Law

The consequences of having the right attorney are great when it comes to family law.

Determinations of custody, parenting time, child support and alimony have far reaching effects. Musto & Alevras can protect your rights and ensure that you are treated fairly.

Robert Musto began his legal career in the Family Court and has been an integral part of it, volunteering his time with the Middlesex County Family Court Committee and the Middlesex County Family Court Early Settlement Panel for most of his career.

These are some of the family law matters that we handle:

  • Divorce and Annulment

  • Custody, Parenting Time, Child/Spousal Support

  • Domestic Violence Restraining Orders

  • Prenuptial Agreements

Municipal Court

Municipal Courts in New Jersey handle a broad range of matters from traffic offenses to violations of municipal ordinances, and certain criminal charges which involve penalties including substantial fines and incarceration.

Although there is no jury present in municipal court, the potential penalties can be severe. With charges ranging from DWI, drug offenses, shoplifting and even speeding, many attempt to represent themselves. However, there are rules of evidence and procedure that can be very confusing and even misleading to people who are unfamiliar with them.

If you are unsure of any of your rights, contact us to understand the charges, penalties, and possible defenses before you face the Judge.

A last will and testament deals with the distribution of your estate after you pass.

A living will nominates the representative of your choice to make health care decisions on your behalf if you are unable to do so. A living will also sets forth your wishes in the event of certain medical circumstances, such as organ donation or terminal illness.

A power of attorney permits a designated representative to conduct fiduciary transactions such as banking or real estate transactions on your behalf if you are incapacitated.

Musto & Alevras can help you prepare for the future by drafting a last will and testament, living will or power of attorney to meet your needs.

Criminal Law

Being charged with a criminal offense is an overwhelming ordeal.  Knowing your rights, options, defenses and strengths or weaknesses of the case against you can be the difference between incarceration and freedom.

Representation should not be left to those who do not know things like the type of sentence you are facing or whether you are eligible for the Pretrial Intervention Program or Drug Court.

Musto & Alevras represents criminal defendants charged with indictable criminal offenses and other areas of criminal law such as of violations of probation and expungements.

Expungement

Expungement is the process of having a Court order that all records relative to a criminal offense are deleted.  This entitles a person who previously had a criminal record to lawfully state that they do not.

Having a record free of criminal offenses is important.  A criminal record can affect your ability to get a job, school admission, benefit eligibility or professional licensure.

Although not all offenses are expungeable, the New Jersey criminal code allows for the expungement of a wide array of offenses from your record.  These include indictable criminal offenses, disorderly persons offenses, ordinance violations, findings of juvenile delinquency and arrests not resulting in conviction.  Contact Musto & Alevras to discuss your options.
